Disclaimer: Please note that by entering into this agreement, you are contracting directly with Net2Phone for phone service. E-Link is not a party to this agreement and does not provide or manage the phone services covered under this contract.

The terms and conditions of this Equipment Rental Agreement are in addition to the Terms of Service agreed to at www.net2phone.com/terms-of-service, which are incorporated herein by reference.

You agree to rent the listed equipment (“Equipment”) as part of a Service Bundle offering, which includes both Equipment and services, plus applicable taxes and fees.

If the Equipment is lost, stolen, or damaged, you shall pay 100% of the Equipment’s then-current list price, plus applicable taxes, and must notify Net2Phone in writing.

Net2Phone retains ownership of all Equipment unless title is transferred in writing after payment is received in full. You agree not to remove the Equipment from the Service Address, lease or sell it, or pledge it in any way.

Warranties Disclaimer

All Equipment is provided “as is,” with no warranties, express or implied, including merchantability, fitness for a particular purpose, or non-infringement, except as required by law.

Net2Phone will replace defective Equipment, subject to the manufacturer’s warranty. Returns may be subject to fees and a re-stocking fee as outlined in the Terms of Service.

Service Commitment

You agree to purchase the services in the associated quote for a minimum of 36 months from the Service Date. The Service term will automatically renew unless canceled with notice provided 30 days before the term ends.

Early Termination

If Net2Phone terminates this Agreement due to non-payment or breach, or if you cancel the Service before the term ends, an early termination fee of $100 per plan or channel applies. You must return the Equipment or purchase it at 100% of its list price plus taxes within five days of termination.

Failure to return Equipment within 30 days will result in a deemed purchase. Net2Phone reserves the right to reclaim Equipment and may charge related fees.

Legal Fees

You agree to pay all reasonable attorneys’ fees and costs incurred by Net2Phone to enforce this Agreement.

Binding Agreement

This Agreement is binding upon your signature. It may be delivered electronically, and electronic signatures are accepted as legally equivalent to manual signatures.
