Empire Technologies LLC dba E-Link (“E-Link”, “we”, “our”, or “us”) provides managed internet and Wi-Fi services (“Wi-Fi Services”) to residential and commercial properties, including but not limited to hotels, multi-dwelling units (MDUs), and senior living facilities. This Wi-Fi Acceptable Use and Privacy Policy (“Policy”) governs your use of any wireless network managed by E-Link and outlines our data handling practices, your responsibilities as a user, and our legal disclaimers.
By accessing or using any Wi-Fi network managed by E-Link, you agree to be bound by the terms of this Policy.
1. Scope and Application
This Policy applies to all users (“you”, “your”, or “user”) who connect to any E-Link managed Wi-Fi network, regardless of the device used or location. It applies to both complimentary and paid Wi-Fi networks, whether accessed through a splash portal, captive page, or pre-configured SSID.
2. Authorized Use
Wi-Fi access is provided solely for lawful and legitimate purposes, including general browsing, communication, business activities, and media streaming. You agree not to use the network for any unlawful, unethical, disruptive, or harmful activities.
Prohibited activities include, but are not limited to:
•Accessing or distributing illegal content (e.g., child exploitation materials, pirated content).
•Uploading or distributing malware, spyware, or viruses.
•Attempting unauthorized access to other systems, accounts, or networks.
•Conducting phishing schemes or fraudulent financial activity.
•Engaging in bandwidth abuse, including sustained large-volume file transfers or torrenting.
•Hosting public servers or running unauthorized business operations over the network.
•Interfering with or disrupting the operation of the network.
We reserve the right to suspend or block your access to the Wi-Fi network if you are found to be in violation of this Policy.
3. User Responsibilities
You are responsible for the security of your own devices and for the data transmitted through your connection. E-Link makes no guarantees regarding the safety or privacy of your device while connected to the Wi-Fi network.
You agree to:
•Use up-to-date antivirus and firewall software on your devices.
•Refrain from sharing your access credentials with unauthorized users.
•Log out of services when finished and monitor your own data usage.
4. Network Monitoring and Data Collection
E-Link may monitor network activity and collect limited technical information for operational, diagnostic, support, and security purposes. Data collected may include:
•Device MAC address
•IP address assigned
•Websites and domains visited (DNS-level)
•Connection time, duration, and bandwidth usage
•Device type and operating system
•SSID and physical location of connection
We do NOT collect or inspect:
•Content of encrypted communications (e.g., HTTPS traffic)
•Personal credentials, emails, or private files
This data is used solely for network support and troubleshooting, abuse prevention, and overall service improvement. Data may be retained indefinitely, unless otherwise required by law or contract.
5. Privacy and Data Sharing
E-Link values user privacy. We do not sell or share user data with third parties for advertising or marketing purposes.
Data may be disclosed only under the following circumstances:
•To the property owner or management for security, support, or billing purposes
•In response to lawful requests by law enforcement or regulatory agencies
•To protect our rights, the safety of others, or to prevent criminal activity
All data is stored securely using commercial-grade security practices. Access to this data is limited to authorized personnel only.
6. Limitation of Liability
E-Link provides Wi-Fi services “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee that the network will be uninterrupted, error-free, secure, or compatible with all devices.
To the maximum extent permitted by law:
•E-Link is not liable for any data loss, theft, interception, or damage to your device arising from your use of the Wi-Fi.
•We are not responsible for service interruptions or slow speeds due to network congestion, technical issues, or external factors.
You use the Wi-Fi network at your own risk.
7. Third-Party Platforms
Some E-Link-managed networks utilize third-party platforms and hardware (e.g., Ubiquiti UniFi Dream Machine, cloud dashboards). These platforms are governed by their own privacy and security practices. E-Link configures such systems to industry standards but disclaims liability for issues stemming from third-party platform vulnerabilities.
8. Content Filtering
Unless explicitly stated otherwise, E-Link does not implement content filtering or block access to specific websites. Each user is solely responsible for their browsing behavior. Property owners may request custom filtering policies via written agreement.
9. Terms of Access and Revocation
Access to the network is provided at the discretion of the property owner and E-Link. We reserve the right to:
•Restrict access to specific users or devices
•Suspend or terminate access for violations of this Policy
•Modify or update the Policy at any time without prior notice
Continued use of the network constitutes your agreement to any revised terms.

11. Governing Law
This Policy shall be governed and interpreted in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Ocean County, New Jersey.
12. Hotel or Property Responsibility
In properties where E-Link operates as a third-party service provider, the hotel or property owner is responsible for ensuring guest communication and consent is appropriately displayed (e.g., via splash page, signage, or terms acknowledgment).
